Districts cannot use look-back periods, as described by the Affordable Care Act (ACA) regulations, to determine employee eligibility for TRS-ActiveCare.
Look-back periods are used to determine whether an employee with variable hours is full-time for purposes of ACA penalties. Whether an employee is considered full-time under the ACA is a separate issue from whether an employee is eligible to enroll in TRS-ActiveCare. Many employees who do not meet the ACA's definition of full-time are nonetheless eligible to enroll in TRS-ActiveCare.
TRS expects all participating districts/entities to offer TRS-ActiveCare coverage to employees once they become eligible and not to delay an offer of coverage based on ACA look-back periods. Retroactive enrollments will not be allowed unless approved by TRS.
