Terms of Use
Your use of the TRS RE Portal (the portal) is governed by the terms and conditions stated in this TERMS OF USE FOR RE PORTAL AND FOR SUBMITTING AND/OR ACCESSING CONFIDENTIAL PARTICIPANT INFORMATION VIA THE PORTAL (Terms of Use) agreement. Your use of the portal constitutes your agreement to follow and be bound by the terms set out herein as well as those set out in any applicable statute or rule, including those making the unauthorized disclosure or misuse of TRS participant information a criminal offense. If you do not agree with any of these terms and/or conditions, do not use the portal and instead notify your employer’s TRS web administrator as well as the TRS Reporting Employer Coach assigned to assist your employer to remove your authority and access to the portal.
Corrections of Errors and Incorrect Information
The information available through the portal may contain errors or inaccuracies and may not be complete or current. While TRS establishes validations for information reported by covered employers that help to ensure the information provided is correct and current, covered employers may submit incorrect or incomplete information that goes undetected for a period of time. Employers may also correct and/or update monthly reports at any time using an adjustment report. For these reasons, it is possible that individual participant information may contain errors that remain uncorrected for a period of time or may be updated or changed at any time. TRS has the authority and reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice to persons authorized to access the portal and/or to the participants.
Your Password Management and Access Responsibilities
Use of your User ID and Password is the agreed security procedure to use the portal and to access the confidential information available to you as an authorized user. All information available via the portal comprises records of participants or information about the records of participants that are in the custody of TRS and as such are confidential and may not be disclosed or used for any purpose other than to comply with TRS reporting requirements or to conduct other official TRS business.
To prevent unauthorized access to confidential participant information using the portal and/or unauthorized use and/or disclosure of confidential participant information obtained using the portal, you must use a User ID and Password. By using the portal you agree to maintain the integrity of the portal by securing your User ID and Password and maintaining the confidentiality of your User ID and Password. Disclosure of your User ID and/or Password to any person(s) or entity(ies) is a violation of the Agreement for Access to the TRS Reporting Entity Portal and Confidential Member Information Agreement as well as this Terms of Use agreement. Upon notice or discovery of a violation of this Terms of Use agreement, TRS will terminate your access to the portal and may pursue redress of any harm caused by your violation of this Terms of Use agreement through any legal means available. TRS may also pursue criminal prosecution if you intentionally make or permit the making of a false record for or statement to TRS in an attempt to defraud TRS.
Limitation of Liability
Under no circumstances shall TRS or any of its employees, non-TRS workers, members of the Board of Trustees, agents, vendors or suppliers be liable for any direct or indirect losses or damages arising out of or in connection with your use or inability to use the portal or the disclosure or misuse of participant information obtained using your User ID and/or Password or device to access the portal. This is a comprehensive limitation of liability that applies to all losses and/or damages of any kind, including general, special, consequential, incidental, exemplary or otherwise, and including, without limitation, loss of data, income, or profits, whether in contract, negligence or other tortious action, even if an authorized representative of TRS has been advised of or should have known of the possibility of such damages.
If you cannot adequately safeguard your User ID and Password or the information that you access, your sole and exclusive remedy is to discontinue using the portal. You acknowledge by your use of the portal, that you are accepting the responsibility for safeguarding access to confidential information through the portal using your User ID and Password and you are accepting the responsibility for safeguarding the confidential information that you access using the portal.
Ownership
All of the information that you access and/or submit to TRS via the portal comprises records of a TRS participant or records of TRS participants or information about records of a participant or information about the records of participants that is in the custody of TRS and must not be disclosed. The information disclosed to you via the portal remains confidential after accessed by you and may not be disclosed to another person or entity by you or your employer, including an agent or vendor retained by your employer to conduct the business of your employer or for any purpose other than TRS reporting requirements or TRS business. Any use of the information obtained via the portal other than use of information to comply with TRS reporting requirements or other TRS business, is prohibited unless the use or disclosure is expressly authorized by TRS in writing.
Terms and Conditions May Change
TRS reserves the right to update or modify the Terms of Use at any time without notice. Your use of the TRS portal following any update or modification constitutes your agreement to be bound by the Terms of Use as changed. For this reason, TRS encourages you to review the Terms of Use whenever you access the portal.
